Drink Driving

Drink driving is one of the most serious offences in Motoring Law. We do not condone Drink Driving in any way but if you have a defence it is important that it is prepared properly by expert motoring lawyers. If you are found guilty of drink driving then the Court must disqualify you from driving, there are very few exceptions to this.

To avoid a ban for drink driving you have to show to the Court that there are special reasons not to disqualify you from driving. The Court will not be concerned that the ban will mean you will lose your job, nor that it will affect someone else. When looking at avoiding a ban for drink driving the Court will only be concerned with special reasons that relate to the offence, not the driver.

A common argument for special reasons not to disqualify for Drink Driving is the spiked drinks argument. This is a very difficult argument to prove and you will need the help of lawyers to argue this for you. You will need to show that someone had added alcohol to your drink and that you weren't aware of this. You will also need to show that this extra alcohol put you over the limit and that without it you would have been within the legal limit for driving. Our access to scientific experts is crucial. Witnesses, including bar staff may be vital in this sort of case and it is important that you act quickly.

Another argument to avoid a ban for drink driving is that you only drove because of an emergency. The Court has strict guidelines as to what amounts to an emergency, as specialist Motoring Lawyers we are able to tell you whether you have a valid argument. If we think it is one that the Court will not accept we will tell you as soon as possible. We do not run cases just for the sake of it, if we think you will lose we will tell you.

If you can show that you drank alcohol after you had driven but before you were breathalised then this MAY be enough to convince the Court that you were not guilty of drink driving.
