12 Points Totting Up
If you have 12 points on your licence over a 3 year period the Court MUST disqualify you for 6 months unless you can show that you will suffer what is termed 'exceptional hardship'.
Exceptional hardship means that you will suffer more than is expected from a disqualification. The way that the Court approach it is that they assume that people will suffer from being disqualified - it is meant to be a punishment, after all. However in some circumstances people will suffer more than is expected.
What might be enough to avoid getting banned? The Court will look into all your circumstances, including the likelihood of you losing your job, and will take this into account. However, just because you are likely to lose your job this is not enough to ensure you will not be disqualified. You will need to show more than that. They will also look into whether other people will suffer as a result of your ban, if, for example, family rely upon you driving them this may be enough.
What won't the Court consider? Any circumstances of the offence. For example, you will not avoid a ban because you were only a few miles an hour over the limit or that you were speeding because you were late for an appointment. The fact that you will have to now catch 3 buses to get to work will not be enough for exceptional hardship; inconvenience is not a factor taken into account.
